Terms and Conditions for The Gravalist Company Events

 

1. Ownership of Intellectual Property

 

1.1. All routes, branding, and related materials, including but not limited to pages, maps, and descriptions (collectively referred to as “Materials”), are the exclusive intellectual property of The Gravalist Company.

1.2. Materials are provided for personal use only and may not be used for commercial purposes or unauthorized distribution.

 

2. Subscription Membership

 

2.1. Membership Requirement

• Participation in The Gravalist Company events and access to exclusive routes requires an active paid annual subscription membership.

• The membership allows riders to register for events and use the provided routes for personal, non-commercial rides.

 

2.2. Membership Benefits

• Access to the full library of curated routes for personal use.

• Eligibility to participate and register for any events hosted by The Gravalist Company.

• Exclusive member updates, route enhancements, and event previews.

 

2.3. Membership Fees

• The annual membership fee is set a checkout page, payable at the time of subscription.

• The fee is non-refundable, except in cases where The Gravalist Company terminates the subscription without cause.

 

2.4. Membership Cancellation

• The Gravalist Company reserves the right to revoke memberships due to violations of these terms, misuse of routes, or non-compliance with event regulations.

• Members may cancel their subscription at any time, but no refunds will be issued for the unused portion of the subscription period.

 

3. Use of Routes

 

3.1. Routes offered by The Gravalist Company are intended for personal rides only.

3.2. Group rides using The Gravalist Company’s routes require all participants to be active subscribers to the service.

 

4. Participation in Events

 

4.1. Participation in any event hosted, managed, or otherwise associated with The Gravalist Company requires riders to sign a Rights and Waiver Agreement (Riders Agreement) prior to participation.

4.2. The waiver agreement includes a clear indemnification clause protecting The Gravalist Company from liability as outlined below:

 

5. Limitation of Liability

 

5.1. The Gravalist Company, its directors, officers, employees, agents, or affiliates shall not be held liable for any injury, death, loss, or damage to property arising from:

• Accidental events during participation.

• Negligent actions of participants or third parties.

 

5.2. Riders acknowledge and accept the inherent risks associated with high-risk sports events, including but not limited to accidents, equipment failure, natural hazards, and unpredictable weather conditions.

 

5.3. By signing the waiver agreement (Riders Agreement), riders agree to indemnify and hold harmless The Gravalist Company from all claims, actions, or demands related to their participation in events, including legal fees and expenses.

 

6. Compliance with Rules

 

6.1. Riders must adhere to all safety guidelines, event instructions, and route regulations provided by The Gravalist Company.

6.2. Failure to comply may result in immediate disqualification from the event without refund or recourse.

 

7. Event Cancellation or Modification

 

7.1. The Gravalist Company reserves the right to cancel, postpone, or modify any event for safety, logistical, or operational reasons.

7.2. In such cases, liability for refunds or damages is limited to the event’s registration fee.

 

8. Governing Law and Jurisdiction

 

8.1. These terms and conditions are governed by the laws of South Africa.

8.2. Any disputes arising from participation in events shall be resolved in the courts of South Africa.

 

Acknowledgment and Acceptance

 

By subscribing to The Gravalist Company and participating in its events, riders confirm they have read, understood, and agree to these terms and conditions.
